CALL TO ORDER

The Board meeting of the Columbia Irrigation District was called to order by President Shawver at 1:00 p.m.  Present at the meeting were:

APPROVAL OF AGENDA
Director Martin motioned to approve the agenda as submitted. Director Ayde seconded the motion.  Motion carried. 

PUBLIC COMMENT
Mr. Lonnie Austin addressed the Board regarding a fence on the corner of 10th Avenue and Gum Street. The fence is located on the fill slope of Lateral #1. He is concerned that the fence’s location could potentially influence the canal and wanted to bring it to the attention of the Board. Mr. Flynn visited the site and determined the fence appears to be outside of CID right-of-way on private property. Mr. Austin exited the meeting at 1:06 pm.

 

CONSENT AGENDA

Minutes of February 21, 2020
Director Ayde motioned to approve the minutes of February 21, 2020. Director Martin seconded the motion. Motion carried.

February Vouchers

Voucher 01 Reimburse Revolving Fund $123,549.32

The Board reviewed and discussed the February Vouchers.  Director Thackham motioned to approve the vouchers as submitted.  The motion was seconded by Director Ayde.  Motion carried.

January Financial Statement
The Board reviewed and discussed the January Financial Statement.

Work Orders by Division
The Board reviewed and discussed the work orders in their respective divisions.

Policy Review Edits
The Board reviewed staff edits made to the Turnout Ownership and Cost Burden Policy and the Board of Directors Policy, reviewed by the Board at the previous meeting. Director Ayde motioned to approve the revised Turnout Ownership and Cost Burden Policy. Director Thackham seconded the motion. Motion carried. Director Thackham motioned to approve the Board of Director’s Policy as revised. Director Ayde seconded the motion. Motion carried.

2020-2021 Attorney Services Contract
The District published the annual request for Statements of Qualifications (SOQ) for the District’s Attorney, as required by RCW 39.80.030. CID received SOQ’s from CID’s current attorney, Sperline Raekes Law and from John Crotty with Western Legal PLLC. Mr. Flynn reviewed the staff evaluation of qualifications submitted. Director Martin motioned to renew the contract for Sperline Raekes.  The motion was seconded by Director Gose. Motion carried.

 

OLD BUSINESS


Gate Use/Access Permit
Mr. and Mrs. Reed (703 S. Beech Street) addressed the Board to request a permit to enter onto CID right-of-way via the Beech Street gate to access their garage in exchange for allowing CID to use Beech Street, which is a private road. Director Ayde motioned to approve an access permit for Mr. and Mrs. Reed for as long as they own the property, with the fee waived in exchange for allowing CID to use their private road. Director Thackham seconded the motion. Motion carried. Mr. and Mrs. Reed exited the meeting at 2:11 pm.

Chandler Electrification
Mr. Flynn stated he had no new information to report.

Reservoir
Mr. Flynn reported he is continuing to work on the grant application and will send it to Mr. Limbaugh to review prior to submission.

Joint Board Associate Membership
The Board discussed whether CID should become an Associate Member of the Joint Board. The annual membership fee is $1,000.00. Director Martin motioned for the District to join the Joint Board as an Associate Member. Director Thackham seconded the motion. Director’s Gose, Martin and Shawver approved. Director Ayde opposed. Motion carried.

Fee Title vs Right-of-Way Presentation
Mr. Sperline explained that a right-of-way is an easement that allows someone having the right-of-way to travel over a property to another property. It is not an ownership right, but a use right. If the owner is someone other than CID, they can use the property in any way that is not inconsistent with CID’s need to use the right-of-way. There are areas of CID canal where it is difficult to determine from historical records, whether it is a right-of-way or fee ownership. In Fee Title Ownership, the District has 100% of the ownership right.

R.O.W Update – Parella and Lopez
Mr. Flynn stated he had no new information regarding the Lopez property. He stated he has asked the surveyor for the Parella property to add more detail on a portion of the survey. Once this is done he will contact Mr. Parella.

Benton County Fairgrounds
Mr. Flynn stated the county has moved excavation equipment to the fairgrounds, but no work has been done yet. He will follow up with them again.

NEW BUSINESS

 

Water Relinquishment Moratorium
Mr. Flynn reviewed the motion from April 6, 2010 which placed a moratorium on water right relinquishments until a policy can be developed and a new place of use can be established. Mr. Flynn recommended formalizing the motion into a resolution. He further recommended the District develop a policy to address the need for water and provide a path to end the moratorium. The discussion was tabled until the meeting of March 20, 2020.

Chiawana Orchards Water Spreading
Mr. Flynn informed the Board of a possible water spreading issue at Chiawana Orchards. Chiawana Orchards leases the land from the Department of Natural Resources (DNR). A parcel of land is using irrigation water that CID is not assessing for. Since discovering the issue, DNR has provided documentation showing the land in question was added to the District. After further research it was discovered this land was being assessed by CID up until it was segregated by the City of Richland in 1996. Records indicate staff was aware of an acreage discrepancy at the time and was in contact with both the City and the County. There is no record of a resolution to the issue. Recently the County contacted CID regarding a boundary adjustment application which includes the parcel in question. The County stated there is an acreage issue that they are working to resolve. CID is waiting for this to be corrected before proceeding with correcting previous years assessments.

Operations Report
Mr. Flynn stated Kennewick Irrigation District is planning to start the Highland Drain repair next week. Mr. Flynn gave the water report. The City of West Richland is working on the Bombing Range Bridge.
